Wedding Heirlooms/ Bouquet Preservation
TERMS OF AGREEMENT
This agreement is between Joanna Hiu Sin Nen (44 769 221 211) (“I” “we” “us”) and the client (“you”). This agreement incorporates any terms of service, privacy policy and disclaimer, as amended by us from time to time.
1. Placing an Order
Your desired service will be secured when the full payment has been received.
2. Payment Terms
All our prices are In Australian dollars (AUD $). The Client agrees to pay us the agreed upon fee for the preservation service before the service is provided. For payments over fourteen (14) days overdue, we reserve the right to charge interest for late payments or terminate the agreement.
3. Performance of Service
3.1 The client agrees to provide the wedding bouquet to the preservation service provider in a timely manner, ideally within 1-3 days after the wedding day. We are not responsible for any damages that may occur during shipping. The client is responsible for organising and covering the costs of shipping the bouquet for preservation. We will provide instructions on how best to ship your bouquet safely.
3.2 The client understands that some flowers may not be suitable for pressing, and we will inform the client if this is the case.
3.3 We will take utmost care in preserving the bouquet but cannot guarantee that the bouquet will remain in the exact same condition as when it was received due to the natural process of pressing and drying. We will select the best quality materials for framing the bouquet but cannot guarantee the exact frame and matting materials used, as availability may change.
3.4 We will provide an estimated completion date for the bouquet preservation but cannot guarantee a specific completion date due to the natural process of pressing and drying.
3.5 We can only preserve flowers that are in good condition. If the bouquet arrives in poor condition, the size of the frame may need to change. If the flowers arrive damaged, we will do our best to create a beautifully preserved artwork. However, if the flowers are unsuitable for preservation, we reserve the right to refuse the preservation service and will inform the client accordingly.
3.6 In the event the wedding is cancelled or postponed, the client is entitled to change dates within reason or regift the services to a third party.
4. Collection
If you are collecting your piece from us, we’ll let you know when they’re ready and make an appointment for you to collect them. The client agrees to inspect the preserved bouquet upon receipt and notify us of any issues within 48 hours of receipt.
4.1 Delivery of products or services
You are entitled to have your piece delivered to you and are entitled at an additional cost. The client agrees to pay for any shipping and handling costs that may occur. We will pack and dispatch the items to a Delivery Service Provider for delivery with tracking to you at the delivery address you give us at the time of placing your order, or another address as nominated by you in writing. The tracking number will be supplied to you by email. 8. We will not be held responsible for any damage caused during shipping or handling once the preserved bouquet has been delivered to the client.
5. Liability
5.1 Subject to this agreement (including all disclaimers and limitations of liability), risk in your custom piece lies with us until it is delivered to you, or you collect it from us.
5.2 You are responsible for the piece from that point onwards, and we won’t be responsible for any loss, damage, wear, or tear to the piece.
5.3 For delivered items, you agree that our liability for any item lost or damaged while in the possession of the Delivery Service Provider is limited to the amount that we recover from the Delivery Service Provider, less our reasonable administration costs.
5.4 We don’t offer delivery insurance as standard with custom orders; however, we recommend that you insure your order. Please contact us for pricing.
5.5 The client understands that the preserved bouquet is delicate and should be handled with care to ensure its longevity. Please display your frame away from direct sunlight or a window.
5.6 The client acknowledges that the preserved bouquet is intended for decorative purposes only and not for consumption or any other use.
6. Returns
6.1 Our custom orders are created through extensive consultation and take a lot more time and work than standard production pieces. As they are made specifically to your requirements, refunds, returns or exchanges are not accepted. All sales are final.
6.2 We’re highly committed to ensuring that each order that leaves our studio is produced to a high standard, so if you’re not satisfied, get in touch with us to discuss how we can resolve the issue.
7. Intellectual Property
We own and retain all Intellectual Property Rights in our custom pieces, including all rights of reproduction. Nothing in this agreement will cause any transfer of our Intellectual Property Rights.
8. No Guarantees
8.1 The process of pressing a wedding bouquet is inherently complex. While we endeavour to create a piece that matches the approved sketch as closely as possible, we can’t guarantee that your piece will look identical to the sketch.
9. Cancellation of Orders
9.1 The client acknowledges that all sales are final, and no refunds or cancellations are allowed due to the bespoke service provided.
9.2 If the wedding is cancelled or postponed, the client may change the preservation date within reason or regift their booking to another party.
10. Termination
10.1 We can terminate this agreement:
10.2 without cause, immediately on giving written notice to you; or
10.3 if any amount you owe us remains outstanding for more than fourteen (14) days after we send you a notice requiring payment.
11. We reserve the right to terminate this agreement immediately by giving written notice to the other party if any of the following events occur:
11. The client commits a material breach of any term of this agreement that is not able to be remedied.
11.2 the client commits a material breach of any term of this agreement that is not remedied within thirty (30) days after written notice is given by the other party.
11.3 the client repeatedly breaches any of the terms of this agreement, evidencing that they no longer intend to be bound by the agreement, or that they can no longer comply with it; or 11.4 the client becomes insolvent, states that it is insolvent or is presumed to be insolvent under applicable law.
12. Consequences of Termination
12.1 Subject to this agreement, on termination or expiry of this agreement, we each agree to promptly deliver, pay or transfer (as the case may be) to the other party any sums or materials which are in our possession or control that are outstanding or to be accounted for under this agreement.
13. Confidentiality
13.1 All parties to this agreement undertake to keep any information about the other party or its business (which is or has been disclosed by that party, its representatives, or advisers) and the terms of this agreement secret and confidential and not disclose any of that information, except with the consent of the other party, where necessary for efficient business operations or where required by law.
14. Photography
We reserve the right to use all photographs of the frame for advertising and promotional purposes on our website, portfolio, social media, brochure, etc. You agree to us taking and using such images as described and release any and all claims regarding use.
This signed agreement serves as a release authorisation for such materials.
By agreeing to these terms and conditions, the client acknowledges that they have read, understood, and agree to the terms and conditions of the wedding bouquet preservation service.
